# \[8] 8 - Failure to Declare a Weapon

Any person found to be in possession of a firearm, weapon, or explosive, regardless of past criminal record or license to carry, who fails to declare the presence of their weapon on their person or in their vehicle immediately after being contacted by a law enforcement officer. This does not apply to weapons that are clearly visible such as those that are being openly carried.

1. Individual does not declare any of the listed above when on a traffic stop.
2. Individual does not declare any of the listed above when being searched.
