# \[8] 3 - Brandishing a Firearm or Deadly Weapon

Drawing or exhibiting a deadly weapon or firearm in a manner which is threatening, instigatory, or shows an intent to use illegally.

The term "**Firearm**" does not include an antique firearm or a clearly identifiable imitation weapon with an orange muzzle tip.

**Examples:**

**1)** Jerome is in a fight with his neighbor and hits him in the head with the grip of his handgun.\
**2)** Eddie lifts his shirt to reveal the pistol in his waistband.\
**3)** Albert makes verbal threats while gesturing a knife in his hand.\
**4)** Jonathan un-holsters his firearm and points it at someone during a verbal argument.
