[2] 6 - Unlawful Imprisonment

Unlawful imprisonment is when a person (who doesn't have legal authority or justification) intentionally restrains another person's ability to move freely.

Misdemeanor Sentence: Up to 15 Month(s) Fine: $500 - $1,500

Examples:

1) During a heated argument, the husband grabs his wife and prevents her from leaving a room; 2) An employee, while upset with a co-worker on the job, locks the co-worker in a closet; or 3) A police officer arrests and detains a suspect without a warrant and with no legal authority.

Defenses:

1) Legal authority to restrain or consent 2) Self-defense or Shopkeepers privilege 3) Parental Rights when suitable
